Program Description
This program is designed to guide the civil defense trial lawyer to handle the obligations imposed by Medicare. It will provide an overview of the Medicare secondary payer law and review many of the new amendments created by the Medicare, Medicaid and SCHIP Extension Act of 2007 ("MMSEA"). Specifically, the MMSEA now requires civil defendants who pay settlements to Medicare beneficiaries to register with the Centers for Medicare & Medicaid Services ("CMS") and to report settlements and payments to CMS. The failure to do so may result in civil penalties of $1,000/day. In addition, civil litigants are now required to protect Medicare's future interest, and this program will discuss strategies similar to the Medicare Set-Aside obligations currently governing worker's compensation actions to meet this obligation.

Speaker Information
Daniel W. Farroll is a partner in the Edwardsville, IL office of HeplerBroom, LLC. Mr. Farroll is licensed in both Illinois and Missouri as well as the Federal Courts in the Bi-State area. He is a member of the Medical Liability and Health Care Law Committee of the DRI, a member of the legal committee for the Illinois Healthcare Association and he co-chairs the Medical Liability Committee of the Illinois Association of Defense Trial Counsel. He litigation practice includes construction liability, product liability and the professional liability areas of medical malpractice, nursing home and insurance broker liability.
Bradford Peterson is a partner in the Urbana office of Heyl Royster Voelker & Allen. Brad concentrates his practice in the defense of workers' compensation, construction litigation, auto liability, premises liability and insurance coverage issues. In recent years, Brad has become a leader in the field on issues of Medicare Set Aside trusts and workers' compensation claims. He has written and spoken frequently on the issue. He was one of the first attorneys in the State of Illinois to publish an article regarding the application of the Medicare Secondary Payer Act to workers' compensation claims "Medicare, Workers' Compensation and Set Aside Trusts," Southern Illinois Law Journal (2002).
